Deputy suggests adding new clauses in Criminal Law to crack down Internet crimes

Zhang Xuedong suggested at a panel discussion that swift development of the
Internet had brought great impact upon our social, political, economic and daily
life. When the people give cheers to the Internet, saying that “the network is a
new way of life”, some illegal behavior in our real life such as virus,
harassment, pornography, drugs and fraud occur from time to time in this virtual
digital world.
On the basis of his survey, Zhang characterized the chaos
in the current network supervision work as follows: first, the fraudulent
practices in the on-line shopping and transactions; second, violation of the law
on intellectual property rights, especially the on-line disputes on copyright
rights and improper competitions have been on the increase; third, lack of
monitoring over on-line false advertisement. All these have provided a breeding
ground for Internet crimes.
Zhang emphasized that although the first section “the
crime of disturbing the public order” in the Chapter VI “the crime of impairing
social management order” of the Criminal Law has stipulated a number of crimes
involving computer crimes, yet it has not made systematic stipulations on
Internet crimes. Thus he suggested that the related authorities should add new
clauses to the Criminal Law on Internet crimes in light of the characters of the
Internet crimes in our society so as to provide legal basis for cracking down on
Internet crimes.
